Srila Prabhupada’s ISKCON Bangalore to go on appeal

 

Battles may be lost but war for Srila Prabhupada will be won Bangalore, 23 May 2011. The divisional bench of the High Court of Karnataka gave its verdict on the appeal filed by ISKCON Mumbai. Honorable Justice H M Nagamohan Das and Honorable Justice Arali Nagaraj today gave their verdict on appeal filed by ISKCON Mumbai and set aside the Civil court’s judgement.

However, ISKCON Bangalore will pursue its case within the legal framework and will appeal against this decision in the Supreme Court. We have full faith in the judiciary of our country and are confident that we will be able to present the case in our favor.

It may be recalled that the City Trial court of Bangalore had given a judgment on April 17, 2009 stating that ISKCON Bangalore is the absolute owner of Sri Radha Krishna temple on Hare Krishna Hill. The Honorable Civil Court judge had also declared that ISKCON Bangalore is an independent legal entity and further restrained ISKCON Mumbai, their agents or representatives from interfering in the affairs of ISKCON, Bangalore by granting a permanent injunction.

Unfortunately, the Honorable High Court today set aside this 350 page judgement and gave its verdict overruling the earlier order.

The genesis of this dispute between ISKCON Mumbai and ISKCON Bangalore is related to the spiritual succession of the movement founded by His Divine Grace A.C. Bhaktivedanta Swami Prabhupada. Srila Prabhupada had taught from the Vedic literatures that an Acharya plays a prime role in the development of Krishna bhakti in the heart of a disciple. In order to play that role of an Acharya, one must have extraordinary spiritual qualifications and purity.

Just months before his physical departure from this world Srila Prabhupada instituted a rtvik system of initiation thro' a written directive sent to all its GBC's and Presidents on July 9th 1977.

He made it clear in this written directive that he remained the diksa guru or the acharya of ISKCON and that his disciples acting as his representatives or rtviks would initiate new disciples as disciples of His Divine Grace Srila Prabhupada. ISKCON Mumbai which is predominantly controlled by foreigners who are themselves voted in unauthorized gurus has disregarded this particular instruction and has manufactured its own system of succession. ISKCON Bangalore on the other hand tries to follow this and many other directives of the founder and acharya of ISKCON Srila Prabhupada strictly.

The ISKCON Bangalore society was registered by one of the pre-1977 disciples of Srila Prabhupada named Shankabrit Dasa in the year 1978 as per the Karnataka Societies registration act 1960. Sri Madhu Pandit Dasa later on in 1984 took over from Shanka Brit Dasa as the President of ISKCON Bangalore and under his leadership the temple complex on Hare Krishna Hill was built and inaugurated in 1997. In 2001 some of the fanatic disciples of ISKCON Mumbai physically stormed the temple of ISKCON Calcutta. Sri Adhridharan Dasa the President of ISKCON Kolkata was ousted from his services as he was a strong proponent of the rtvik system of initiations.

Knowing that the fanatic followers of the unauthorized gurus will try to similarly storm the temple and harass the devotees and disturb the various initiatives of ISKCON Bangalore, we discussed with legal experts and concluded that legal recourse was unavoidable and only solution for protecting the legacy of Srila Prabhupada and his movement from these gurus and there fanatic followers.

ISKCON Bangalore (registered in 1978) approached the courts to restrain ISKCON Mumbai from interfering in the affairs of ISKCON Bangalore. The then Honorable Judge of the High Court Justice A M Farooq gave his verdict on the interim application and passed interim order restraining ISKCON Mumbai(registered in 1971) from interfering with the affairs of ISKCON Bangalore on April 20th 2002. In his order he said “ There shall be an order of temporary injunction as prayed for by the plaintiff(ISKCON Bangalore)the respondent defendants (ISKCON Mumbai)… are hereby restrained from interfering with the plaintiff’s peaceful possession of the suit properties…”

ISKCON Mumbai went on appeal against this interim order to the Supreme Court, which gave its verdict that it will not interfere with the High Court’s order and that it will maintain the interim order. Honorable Justices VN Khare and Ashok Bhan said in the verdict “In view of the fact that the interim injunction has been passed pending hearing of the suit we are not inclined to interfere in the matter.”

The City Civil court later heard the main civil suit on a day to day to hearing and perused close to 700 documents submitted by both parties and gave it final verdict on April 17, 2009 stating that ISKCON Bangalore is the absolute owner of Sri Radha Krishna temple on Hare Krishna hill. The Honorable Civil Court judge also had opined that ISKCON Bangalore is an independent legal entity. The civil court had further restrained ISKCON Mumbai or their agents or representatives from interfering in the affairs of ISKCON, Bangalore by granting a permanent injunction.

Today the divisional bench of the High court, presided by Honorable Justice Nagamohan Das and Justice Arali Nagaraj, after hearing the various arguments about the city civil courts’ orders by both sides gave its final verdict and set aside the civil court’s order April 17th 2009.

For ISKCON Bangalore, this is not a fight for properties but a sincere effort to re-establish Srila Prabhupada as the sole acharya or diksha guru of ISKCON. We are confident that truth will prevail and by the mercy of Sri Radha Krishna-chandra, our services to Their Lordships will continue unhindered.

May 24^th 2011 Bangalore. The divisional bench of the High court of Karnataka today restrained ISKCON Mumbai from dislodging or removing Sri Madhu Pandit Dasa as President, other office bearers and employees of ISKCON Bangalore for 6 weeks. The High Court further observed that there are various yeoman services being rendered from the institution to the society and abrupt changes in the management, missionaries, employees and other members would disrupt the same leading to far reaching consequences.

The High Court also observed that other activities, organizations or trusts which are functioning from the Hare Krishna Hill premises are not part of this suit and hence their activities should go on unhindered.

The divisional bench of the High Court was giving their decision on the stay petition filed by ISKCON Bangalore. It may be recalled that the High court had set aside the verdict given by the Trail Court of Bangalore which had given absolute ownership of Sri Radha Krishna-chandra temple on Hare Krishna Hill to ISKCON Bangalore Society registered in 1978.

The counsel for ISKCON Bangalore said that the stay petition is not about the verdict and hence should be considered on the following grounds:

1. ISKCON Bangalore has been in de-facto possession of the Hare Krishna Hill premises for the last several decades and various court orders were in its support.

 

2. The practicality of any transfer of management will not be possible on an immediate basis.

3. ISKCON Bangalore has already given an undertaking in the Supreme Court that it will not alienate or part with the assets, and are willing to submit to any process of reporting to the court.

After hearing the  objections of ISKCON Mumbai to this stay petition, the High Court bench consisting of Justice Nagmohan Das and Justice Arali Nagaraj gave their restraining order that ISKCON Mumbai shall not invoke their constitutional powers to dislodge Madhu Pandit Das, other current functionaries, missionary devotees and employees of ISKCON Bangalore serving in the temple from their services. The court also stated that Akshaya Patra and other trusts which are functioning from Hare Krishna Hill where ISKCON temple has been built are not party to the case and should function on their own. This order shall facilitate the smooth functioning of the various activities of ISKCON Bangalore and at the same time enable ISKCON Bangalore to file an appeal in the Supreme Court.

“ISKCON Bangalore will file an appeal in the Supreme Court shortly after obtaining and studying the order copy. We have full faith in the judiciary of our country and are confident that we will be able to present the case in our favor,” said Madhu Pandit Das, President of ISKCON Bangalore.

Guru Fraudster’s Plan Fails

In Bhagavad-gita Krishna says,

sarvasya cähaà hådi sanniviñöo
mattaù småtir jïänam apohanaà ca

I am seated in everyone’s heart, and from Me come remembrance, knowledge and forgetfulness. (Bg 15.15)

Well to me it seems that Krishna has proved this fact very much. The guru hoaxers had nicely preplanned the series of events which is as follows – High Court will not approve the stay and since the vacations are going on, it would be very difficult to get postings in the Supreme Court for an appeal. In the mean time in these 5-6 days, they would take over the temple by force. But how sad and unfortunate it is that Krishna smashed their plan completely. He inspired the honorable judges to pass the order that Madhu Pandit Prabhu should not be removed as a President and other office bearers for next 6 weeks. We have lost the battle but the war is not yet over. Not to forget to mention that to protect the temple where His pure devotee is being worshipped, Krishna also gave inspiration to the judge to pass the order that more than 5 people from the guru hoaxer’s camp are not supposed to gather near the temple. In the name of Nagar Sankirtana, they planned to barge in the temple by force to take it over. But Krishna smashed them on their heads and they had to bite their teeth and sit.

Lord’s plan is much bigger to unfold ahead falling like an ice rain on them. Watch out!

May 28, 2011 — BANGALORE, INDIA (SUN) —

 

The High Court of Karnataka has restrained ISKCON Mumbai from removing Madhu Pandit dasa as the President of ISKCON Bangalore. The court has further instructed that Madhu Pandit dasa and other functionaries should continue to function and discharge their duties in accordance with bye laws.

 

The supervisory committee formed by ISKCON Mumbai is unconstitutional and it is a veiled method of interfering with the management of the temple, which the High Court has restrained them from. Further, ISKCON Mumbai has to take de-facto physical possession of the temple only through a due process of law, through a procedure as approved by a court of law, and not just walk in. The temple is a running organization having several moveable assets. Any change of hands has to be recorded through court supervision. We have also complained to the Police that our de-facto possession for all these years has to be protected until they have direction from the court.

 

Meantime we are preparing to appeal the Order of the High Court of Karnataka before the Supreme Court and obtain a stay order on the judgment before the expiry of six weeks. The supervisory committee has been formed by ISKCON Mumbai just to put impediments in the process of our appeal to the Supreme Court.

The ongoing tussle between the Bangalore and Mumbai centres of International Society for Krishna Consciousness (Iskcon) to control the temple premises in the city could affect 5.5 lakh school students in Karnataka.

The row has resulted in dearth of funds and Iskcon Bangalore has decided to drop its expansion plans, particularly the flagship project — the mid-day meal scheme for school students through Akshaya Patra Foundation.

Iskcon Bangalore was planning to extend the mid-day meal service to another 1 lakh students this year. However, it has now shelved the plan because of the legal battle.

The legal battle has also affected the flow of donations and Iskcon Bangalore is left with few options, but to drop its expansion plans.

“Though high court of Karnataka has ordered Mumbai Iskcon not to disturb the mid-day meal scheme of Akshaya Patra Foundation run by Bangalore Iskcon, but practically we are facing several problems.

It is very difficult to manage. We are trying to overcome the problems and continue the mid-day meal scheme, but in the coming days it may get hit,” said sources in Iskcon Bangalore.

According to the sources, if the same situation continued, it might have to stop the service or quality of food might suffer. The state government is offering just 3 Rupees a meal for the scheme, but Iskcon says it is spending 6 Rupees a meal, thereby offering the service at 50% discount.

Through the mid-day meal scheme, Iskcon Bangalore feeds 2.2 lakh students in the city. Over 13 lakh students in eight states also benefit from the scheme.

Bangalore Iskcon also feeds over 10,000 people in Bangalore under the senior citizen feeding project.

Supreme Court Restrains ISKCON-Mumbai | ISKCON-Bangalore

June 06, Press Note, Bangalore, India — The Honourable Supreme Court today restrained ISKCON Mumbai society from interfering with the day to day management of the ISKCON-Bangalore. It also instructed both the parties to maintain status quo.

The court further said that the ISKCON-Bangalore society office bearers should continue with the day to day affairs and the supervisory committee of ISKCON Mumbai has been restrained from interfering in any way or barging in.

The court also ordered that the plaintiff society (ISKCON-Bangalore) will manage the day to day affairs and that ISKCON Mumbai should not interfere.

The divisional bench of Honorable Justice Sri B.S.Chauhan and Justice Sri Swatantra Kumar were giving an order on the special leave petition filed by the ISKCON-Bangalore Society. The divisional bench admitted the SLP and heard arguments presented by Sri U. Lalith, the senior counsel for ISKCON-Bangalore.

The counsel for ISKCON-Bangalore explained that the difference between ISKCON Mumbai and ISKCON-Bangalore pertains to the issue of spiritual succession of the Acharya post the physical departure of its founder Srila Prabhupada.

The honourable judges asked for the registration copies of both the societies and accepted the leave petition and listed the matter for further hearing.

The copy of the order will be represented as soon as we get a copy. We request the media to take note of deliberate misrepresentation of the order of the Supreme Court by the agents of ISKCON Mumbai.

June 8 2011, Bangalore, India — Amongst the tension and tussle in Bangalore after the Hon’ble High Court’s verdict, May 29th was a memorable day for 37 devotees in the temple here. On the auspicious appearance day of Srila Vrindavana Dasa Thakura, 37 devotees took shelter under the lotus feet of Srila Prabhupada and accepted him as their spiritual master. I was one among the 37 devotees who took diksha from Srila Prabhupada on that day.

 

Everything was as how Srila Prabhupada instructed in July 9th Directive. We had to first write a test for 200 marks and to pass this test we had to score minimum 150 marks (By Srila Prabhupada’s mercy I scored 198; question paper was little easy). After we pass in the test, we are interviewed by our Group Coordinator (We have a very nice and well organized Krishna Ashraya Program in temple).

Once the group-coordinator’s interview is cleared, we then go for an interview with the Temple President. And once the Temple President is satisfied, he recommends the candidates for the initiation. All these processes are basically to test the candidates that whether they can keep up to the standards enshrined by Srila Prabhupada.

Then the candidates attend the grand initiation ceremony. We all were made to sit in front of the Deities and Srila Prabhupada’s altar. One by one we vowed in front of Srila Prabhupada for chanting 16 rounds everyday and following the four regulative principles throughout our lives. Then our names were announced by the Temple President.

My name is Agrani Krishna Dasa meaning the servant of Krishna who guides His devotees back to His Supreme abode. And some other names were Annapurna Devi Dasi, Amalabhakta Anjaneya Dasa, Urjita Krishna Dasa, Srikara Govinda Dasa, Nakula Dasa, Nirantara Radha Devi Dasi, Narakesari Dasa, etc. After hearing our name we had to pick our malas which were chanted upon by the ritviks. After that Vaishnava homa and guru-dakshina – this made our initiation process complete.

Every step of this process, we all always felt only one thing – we are getting the shelter of a pure devotee now, who will accept us as his disciple formally. Now it all lies in our hand that we should follow the vowed instructions strictly, take the instructions of Srila Prabhupada as our lives and soul and execute his will. Initiation is just the admission. But the real teaching happens in the classrooms.

I had been hearing from many disciples of the gurus that they need to feel being initiated and that can happen only if the guru is initiating you physically, gives you a mala and then gives you the name. I was wondering if this initiation was to be such a feeling than the initiating guru becomes the “Physical Master” and not the “Spiritual Master”.

There are evidences of many disciples who got initiated during the physical presence of Srila Prabhupada but they had not seen him even once in their life time. Does that mean that they were not initiated by Srila Prabhupada and not his disciples?

Srila Prabhupada is a bonafide spiritual master and a representative of the guru-tattva, Lord Balarama and Lord Nityananda. He is on the absolute platform and has the potency to be present through his vani, his instructions, and his books. Is this not enough for all of us to come and take his shelter?

Do these people accept false gurus just for a fashion? We are all the disciples of Srila Prabhupada and it is not very hard to realize this. We need to just approach Prabhupada and pray to him for his ultimate mercy. Rest he shall take care.

“Why disturb a temple that is so greatly spreading Krsna Consciousness and even surpassing all ISKCON temples in its performance.”

Dear Rama Prabhu, they are all envious of the grandeur of the temple. They are all missing the real punch of the temple environment and its grand festival celebrations. They are all missing the activities here which happen to satisfy Srila Prabhupada, a pure devotee of Lord Krishna and by whose mere presence the atmosphere is converted into Vaikuntha.

“Who exactly in ISKCON is behind the main thrust to dismantle the Bangalore temple from Madhu Pandit, and therefore who exactly has spent the great sums of money to accomplish this in the courts?”

The two main persons involved in this are His Holiness Radhanath Swami Maharaja and His Holiness Jayapataka Swami Maharaja. They are the main funders. Then their action men are Sriman Varada Krishna Dasa and Sriman Dayarama Dasa.

 These two men are very notorious and envious. They have not left any stone unturned to bring down this temple. They have spent one and half crores after the High court verdict to create false propaganda in media. Before that how much they have spent on media to defame this temple, there is no account of that.

Dayarama Dasa runs his own business – a civil construction company, PILES Foundation and makes his personal income. He himself declares the same in the following article (http://www.prabhupadanugas.eu/?p=20324&cpage=1#comment-2629). Dayarama has been permitted by GBC men to build his apartment in Mayapur by spending crores of money and to sell those apartments to devotees at a much higher cost. All Prabhupada disciples! Please watch out, your money is not going to Temple Construction Fund but for this fighting. And we also don’t know how much his pockets are becoming lengthy. There is no accountability of the same. So next time when you purchase flats from Dayarama please question him about this.

Being ISKCON leaders, how can they be involved into such personal businesses? Where is the question of personal money for them? I was shocked when I also heard that Bhima Dasa visits US once in a year to do some special business on US beaches. Why are these things required for these leaders? Why are they having personal funds and filling their own pockets? Why are GBCs not questioning them and allowing them to do so? Just because DRD and VKD are fighting the battle for them?

GBC’s are recommended to pool money on temple construction rather than fighting for this cause. Why can’t they just leave devotees peacefully and allow them to follow Srila Prabhupada? Have they committed any wrong by accepting Prabhupada as their spiritual master? Where is it mentioned that we should reject Prabhupada and surrender to these gurus? Why should we? We are not guaranteed of our advancement in devotional service by these gurus. But Prabhupada has promised, if one follows his instructions, one can surely go back home, back to Godhead.

Dayarama Dasa and Varada Krishna Dasa want to become the President and Vice-president of this temple. This is their main interest. They just want to bring down this beautiful temple which serves as an example for running the temple successfully, which is run as how Prabhupada wanted to be – massive prasadam distribution, massive book distribution, intelligent devotees joining full time, thousands of them coming and appreciating the beauty of the Lord and chanting the holy names, gorgeous Deity worship, and what not?

All Srila Prabhupada’s disciples watch out. He is going to use the money from apartments in fighting the case. Your own money to fight your own spiritual master! Or it might go into his pocket.

   This fellows DRD and VKD(Wicked) are the cheapest i ‘ve ever seen in this movement( i ‘ve only seen “sumedhasa” whom Chaitanya Mahaprabhu describes to carry forward this movement in ISKCON Bangalore).

   VKD and DRD are so dumb headed that they dont understand even SP’ july 9th letter.. They simply are behind the property(Not even RKC, KB, NG, SG, PN.. Sorry to say.. but true).

   If this Glorious temple would ve been in ISKCON Mumbai’s hands, then I bet.. They wouldnt ve done so many thing like starting so many centers… Grand AkshayaPatra.. Krishna Leela theme Park… etc etc( List goes on)

   These Ba****ds should not be allowed inside temple only….

   SP is the ONLY DIKSHA GURU of ISKCON…( see July 9th letter, u dumb-headed VKD and DRD)

   pamho agtACBSP i know lots of people who feel sick to hear about the guru hoax who took over the spiritual movement of our beloved acharya. Some are traumatized regarding the cheating what contaminated the actual iskcon.

   With a polluted mentality that they will be number one in the future without establishing our eternal relationship to SRI SRI GURU GAURANGA what is the primary goal of human life, it would be good that some of these kangoorus now say i give you diksa on behalf of SRILA PRABHUPADA.

   Why not, instead of to be overcome by dishonour bad reputation etc..

   Now these demons want to take over iskcon bangalore and we still treat them nicely by accepting court procedure.

   If it were in Sicily the place where i was born all these demons were already in Yamaraja’s abode without given them the chance to argue for what they done to HDG ACBSP.

   Anyway they are in trouble and this is just the beginning because there is no perfection for robbers what to say about happiness when they already lost everything by going against our beloved acharya.
